RESOLUTION

The South African Judges Commission

 

WHEREAS meetings facilitated by the Venice Commission have been held from time to time between Chief Justices of the southern and eastern African region and representatives of Chief Justices of the region to discuss matters of common interests relevant to the judiciaries of the region and their role in upholding the rule of law and human rights in the region;

 

AND WHEREAS the first meeting of the Chief Justices was held in Zanzibar, Tanzania, on 21-22 July 2003, where the Chief Justices of the Southern African region agreed to the establishment of the Commission;

 

AND WHEREAS the Southern African Judges Commission was established and the founding document adopted on 7 December 2003 at an official signing ceremony in Benoni, Johannesburg, South Africa;

 

AND WHEREAS the Chief Justices of the region are present or represented at the Annual General Meeting facilitated by the Venice Commission and held in Windhoek, Namibia 11-13 August 2005;

 

RESOLVED:

That Annexure A of the Constitution of the Southern African Judges Commission shall be amended so as to include the Republic of Kenya as one of the Designated Countries which shall form part of and be bound by the provisions of the said Constitution.

 

Resolution was passed by a majority vote of above 75% of the members of the SAJC.

 

Unanimously agreed to and adopted by the Chief Justices and senior Judges in attendance.
