Training for the Civil Service
Progress report
1. Introduction
The objectives of
the legal training for the Civil Service organised by the European Commission
for Democracy through Law have been fixed as follows:
-
to organise
training sessions for participants from several states, the aim of which would
be the exchange of information on participants’ experience and difficulties in
implementing law in different national contexts, in order to identify common
issues and find ways of settling them, as well as to organise conferences on
concrete subjects;
-
to organise
training seminars involving participants from one State which will focus on
problems specific to that particular State.
The European
Commission for Democracy through Law organised in Trieste from 11 - 12 December
2001 a seminar to launch the UniDem (Universities for Democracy) project for
the legal training of civil servants. This seminar was attended by
representatives from Albania, Bulgaria, Croatia, Moldova, Romania, Slovenia and
“The former Yugoslav Republic of Macedonia”. Representatives of schools and
institutions for the training of civil servants from Germany, France, Italy,
Portugal, Spain, Switzerland and the United Kingdom also attended the meeting
(DocsCDL-SP(2000)3 and 4).
During the seminar of 11 – 12 December it was
agreed that each State should propose 9 candidates for each training session.
The Venice Commission would then select three participants per country. The
dates for the first seminar on "Public Administration and the Individual
in the light of the European Convention of Human Rights" were fixed for 14
– 18 May 2001. The second session on "The Principle of Non-Discrimination and the
Protection by the Public Administration of the Rights of Ethnic, Cultural and
Linguistic Minorities" was scheduled from 11 – 15 June 2001.
Both
seminars took place on the dates indicated above.
Other training sessions during 2001 will concern
subjects such as: Control of administrative bodies: judicial control,
parliamentary control, the Ombudsman (24 – 28 September); The guarantee of
property rights in the new democracies of Central and Eastern Europe, in
particular in the context of privatisation and restitution (22 – 26 October);
Efficiency of the public service and fundamental rights of civil servants (26 –
30 November).
2. The
seminar on "Public Administration and the Individual in the light
of the European Convention of Human Rights", 14 – 18 May 2001.
25 participants attended this seminar. The working
language of the seminar was English. The Venice Commission invited 6 lecturers
(see both lists in appendix II).
Both participants and lecturers were very positive about the
seminar. Representatives of all 9 countries beneficiaries participated actively
in discussions. After the seminar the Secretariat received numerous comments
and suggestions as to practical and academic issues concerning the organisation
of the activity, which helped to adapt the programme of the second seminar to
the expectations of countries participating in the project.
No major shortfalls can be indicated for this seminar.
However, some countries participating in the project have not respected the
deadline for nomination of nine candidates. The national authorities have to
prepare the lists in advance in order to facilitate the reservation of pre-paid
tickets, hotel rooms, etc.
3. The second seminar on "The
Principle of Non-Discrimination and the Protection by the Public Administration
of the Rights of Ethnic, Cultural and Linguistic Minorities" (11 – 15 June
2001).
The second Seminar of the Unidem Campus was
held in French in Trieste from 11-15 June 2001, with 21 participants from the
Stability Pact countries (except “The Former Yugoslav Republic of Macedonia”,
which did not manage to present a list) and 8 professors (the list appears in
appendix IV).
The Seminar was considered very useful and
interesting and the participants suggested repeating it in English because
there are more English-speaking officers in national administrations dealing
with minority issues.
The lectures and seminars were followed with
great interest, particularly when some practical cases have been faced. This
practice should be applied for future seminars.
The general organisation of the seminar was
considered to be very good by the participants and by the professors.
The
participants have made a number of suggestions as for the topics for seminars
in 2002 as follows:
The
protection of minorities (in English);
The
principle of non-discrimination (a
seminar dedicated entirely to this issue);
The
application of the European law in internal legislation;
The
European Charter for the Human Rights;
The
European funds for minorities.
4. Proposals for the future seminars
1) It was decided to engage a consultant
for the organisation of the second seminar in Trieste. This arrangement proved
to be very useful and continuing this practice for the forthcoming seminars has
been considered to continue.
2) The authorities of the
beneficiary countries should present the lists of nine candidates in due time.
The Secretariat has informed the participating institutions about the dates of
the seminars to be held in 2001 and has indicated the date limits for the
presentation of lists.
3) The first two seminars
have been organised in the Trieste business school (MIB) premises through an
intermediary of the authorities of Trieste. The Commission evaluate its
co-operation with MIB as a positive experience (quality of premises, technical
equipment of the meeting rooms, staff assistance, low cost) therefore it could
be continued on the same basis.
4) The Commission has set
the dates for the training sessions for 2001 with the Trieste authorities and a
reservation for the premises for the next three training sessions (September,
October and November) has been made in advance.
