Poland - draft opinion leaked

Strasbourg, Council of Europe - The Venice Commission regrets that the draft opinion on the amendments to the Law on the Constitutional Tribunal of Poland was leaked to a Polish newspaper. Such draft opinions are restricted and not public documents since they do not reflect an official position of the Commission as a whole. In order to prepare the discussions at the plenary sessions of the Commission draft opinions are circulated to a large number of people and institutions – the members and substitute members of the Venice Commission, the Permanent Representations of member States at the Council of Europe, institutions taking part in the work of the Commission and representatives of the state concerned.

Under these circumstances it is not possible to identify the origin of the leak. Opinions become public following their adoption by the plenary of the Commission. In this case of the Polish draft opinion, adoption is foreseen at the next session of the Commission on 11-12 March.
