Council of Europe, Strasbourg - Following the spread of the COVID-19 virus, the Enlarged Bureau of the Venice Commission decided not to hold the scheduled 20-21 March 2020 plenary session in Venice.
Instead, today, three opinions were adopted by a written procedure, as follows:

• Armenia: the Joint Opinion with the OSCE/ODIHR on draft amendments to the legislation concerning political parties;

Venice, Scuola Grande di San Giovanni Evangelista - In its first plenary session of 2019, the Venice Commission adopted the opinion on the introduction of a separate system of administrative courts in Hungary. Hungarian Justice Minister László Trócsányi attended the session on Friday 15 March.

Other adopted opinions concern the revision of Luxembourg’s constitution, legal provisions on the relationship between the prosecution and the police in Georgia and on the Judicial Council of North Macedonia.

Emergency powers -
 What standards?

 


During the current Covid-19 pandemic, national governments are taking exceptional measures to slow down the spread of the virus. On numerous occasions, the Venice Commission examined the limits of such emergency powers. The Commission has consistently underlined that State security and public safety can only be effectively guaranteed in a democracy which fully respects the rule of law. Even in genuine cases of emergency situations, the rule of law must prevail.
