Urgent request for opinion / country visit - POLAND

The Marshal of the Senate of Poland, Mr Tomasz Grodzki, requested a Venice Commission opinion on the amendments to the Law on Organisation of Common Courts, the Act on the Supreme Court and some other acts, adopted by the Polish Sejm on 20 December 2019.
These amendments were to be examined by the Senate at the upcoming January Session. For this reason, the Bureau of the Venice Commission authorised the preparation of an urgent opinion by the rapporteurs.

A Venice Commission delegation visited Warsaw on 9 and 10 January 2020 and met with the requesting authority and other interlocutors.

The urgent opinion was made public on Thursday 16 January 2020.

 What standards?


During the current Covid-19 pandemic, national governments are taking exceptional measures to slow down the spread of the virus. On numerous occasions, the Venice Commission examined the limits of such emergency powers. The Commission has consistently underlined that State security and public safety can only be effectively guaranteed in a democracy which fully respects the rule of law. Even in genuine cases of emergency situations, the rule of law must prevail.
